The Dunlop Art Car Competition will be conducted by GOODYEAR DUNLOP TIRES OPERATIONS S.A., a company organized and existing under the laws of the Grand Duchy of Luxembourg, having its registered office at avenue Gordon Smith, 7750 Colmar-Berg, Luxembourg (previously known as Goodyear Luxembourg Tires S.A., and hereinafter referred to as the “Organiser”). This competition will simultaneously take place in Germany and Austria (to be confirmed), France, Spain and Portugal (to be confirmed), BeNeLux, the Nordics and the United Kingdom. References to Dunlop in these Terms and Regulations include the Organiser and its affiliates. By participating in the Dunlop Art Car Competition, the participant explicitly accepts these Terms and Regulations.
The Dunlop Art Car Competition will open on 16th March 2012 with voting opening the same day. Closing date for entries and voting is up to and including the 10th May 2012. Any designs received before or after these dates are not valid and will not be eligible to participate in the Dunlop Art Car Competition.
Participation in the Dunlop Art Car Competition is open to any member of the public whose permanent place of residence is within the United Kingdom and excludes companies and professional graphic designers. Employees of the Organiser and employees of the Organiser's affiliates and their employees are also excluded.
The participants must be at least 16 years old and need to register through the Dunlop Art Car Competition's website (http://artcar.dunlop.eu), submit their personal data and accept the Terms and Regulations of the Dunlop Art Car Competition. Once the terms and regulations have been accepted, access to the download area of the website will be granted, from which the artwork templates necessary for the design of the Dunlop Art Car may be downloaded. For the submitted design to be valid for participation in the Dunlop Art Car Competition, participants have to submit their design online as a .jpg or .pdf file within time frame of the Dunlop Art Car Competition. The file shall not exceed 500 KB. Each participant is entitled to submit a maximum of one (1) design in his respective country of residence. For determining the winner of the Dunlop Art Car Competition, the jury will consider all designs received by the Organiser within the time frame of the Dunlop Art Car Competition, and at the latest at 23:59:59 hrs (GMT + 1) on 10th May 2012. The requirements, guidelines and stipulations relating to the designs are available online at the following address (http://artcar.dunlop.eu).
Dunlop shall have the right to include additional sponsor logos in the winning design. Dunlop reserves the right to alter, edit or customize the winning design to meet production requirements. The participants explicitly agree to such use by Dunlop.
All design proposals received before the closure of the Dunlop Art Car Competition will be judged and evaluated by a jury of experts appointed by the Organiser. The jury will nominate two designs and the public may vote for a third and fourth favorite design on the Dunlop Art Car Competition website. For this reason, every participating country will have four (4) national winners who will be notified by e-mail or telephone. The national winners from each participating country will then take part in the European semi-final. Each of these four national winners will receive the choice of either: 1. A set of Dunlop tyres, in accordance with the requirements of their vehicle (subject to availability).
Or
2. Two VIP tickets to a remaining Dunlop MSA British Touring Car Championship 2012 (BTCC) event. These tickets will be for one of the remaining seven rounds of the 2012 BTCC, the first event being on 10th June 2012 and the final event being on 21st October 2012. Tickets include, entry to the track, paddock entry and hospitality including food and drink. Dunlop cannot guarantee tickets for the entrants nearest event and there is no cash alternative.
A jury of experts, appointed by the Organiser, will nominate 3 winning designs and a fourth winner will be chosen by the public. For this purpose, the participants agree that their designs may be published on one or more of the Organiser’s and/or the Organiser’s affiliates’ websites. The final European winning design will be chosen by a jury of experts, appointed by the organiser, with the winner being notified by phone or e-mail. The European winner will be invited to attend the Le Mans test day on the 3rd with flights and accommodations being provided by the organisers. The European winner will then attend the Le Mans test day on the 3rd of June to witness the announcement and unveiling of their design to the press by the organisers appointed jury. The final European winner will receive the following:
European competition runners up will receive the following: A signed canvas print of their design.
The Organiser does not commit itself to using any of the designs submitted, which also includes the winning design.
By taking part in the Dunlop Art Car Competition, the participant confirms that he is the author of the work performed and the owner of the unrestricted copyright, should his work and the motif used become eligible for copyright. In the event of the participant winning the international competition, the Organiser will be entitled to seek additional written confirmation from the participant stating that he is the owner of the unrestricted copyright for the motif and the work submitted.
By participating in the Dunlop Art Car Competition, the participants explicitly agree that their exclusive rights of use for the designs submitted will be transferred to the Organiser - and that the Organiser is allowed to assign the right of use especially to other affiliates - if participants are among the winners of the Dunlop Art Car Competition. In addition to the United Kingdom the transferred rights of use will apply to all EU member countries, subject to any diverging national copyright regulations. Participants explicitly waive any recourse to legal action to the extent permitted under the laws of their participating country of residence.
The Organiser, Dunlop and all further holders of user rights may, at their discretion, exhibit the best designs and/or use them, for instance, on racing cars, in press releases, promotional programs, magazine articles, calendars, posters, websites, miniature vehicles, videos and photos or incorporate them into other artistic work or media. The Organiser and its affiliates are also entitled to reproduce, distribute and dispose of these designs. The national and European winners will grant the Organiser, Dunlop and their affiliates the right to publish their names and pictures in any material and information relating to the Dunlop Art Car Competition as well as to reproduce their winning designs in publications concerning this competition.
The participants are only allowed to use the data provided by the Organiser, particularly any data referring to the Organiser's and Dunlop’s brands and those of their affiliates, in order to create their designs in accordance with the online "Assignment/Manuscript" provisions. Any other use of this data is prohibited. The data may not be copied for the purpose of commercial use or distribution, nor may they be altered or published in any other media without the prior written permission of the Organiser. The Organiser and its affiliates reserve the right to take legal action in this regard against any breach of this provision, and to claim damages.
When submitting their participation forms through the relevant website, the participants will provide the Organiser with their personal data. The Organiser is responsible for the storage, use, processing and transfer of the personal details of all participants. During all data processing transactions (e.g. recording, processing and transferring data), the Organiser will act in accordance with the legal regulations. The data necessary in order to conduct the Dunlop Art Car Competition will be stored and forwarded to Dunlop and the Organiser’s and Dunlop’s affiliates to the extent necessary to carry out the Dunlop Art Car Competition. Any such data transfer will only take place within the EU and Switzerland.
Participants may object to the use, processing and transfer of their personal data at any time by sending a note to the following email address: dominic_gryszan@goodyear.com If the objection is submitted before completion of the Dunlop Art Car Competition, the participant will no longer be able to take part in the competition, as his contact data will no longer be available. Participants explicitly waive any recourse to legal action in this regard to the extent permitted under the laws of their participating country of residence.
